DEP does not have the authorization to waive Army Corps approval, so we submitted a simplified application to the Army Corps in May 2016 and are awaiting their authorization to proceed with the project.Concurrently, we submitted an NPDES permit to the County for earth disturbance in excess of an acre. We have received a technical review, but are waiting to respond until Army Corps makes an official determination.
